Injured Worker Seeks Damages after Fall

An Aurora man has filed a lawsuit alleging he was injured on the job as the result of his employer’s Occupational Safety and Health Administration (OSHA) standards violations.

Darrel Fint filed his complaint in US District Court for the Southern District of West Virginia on September 26, 2017. The suit claims Brayman Construction Corporation’s OSHA violations caused him to fall backward into an un-barricaded hole while he was assisting a Hinton drill crew on the job in January.

The fall caused him to sustain severe, permanent, and catastrophic injuries, including a broken neck. Fint has undergone extensive major surgery and experienced loss of body functions. His injuries and subsequent recovery caused him to miss time from work and loss of earnings, as well as continued mental anguish. His medical expenses were enormous.

Fint claims Brayman Construction Corp. is responsible for his injuries because the company allegedly failed to install a barricade around the hole to protect from holes.

Plaintiff Seeks Damages after Fall

Fint has requested a trial by jury and is seeking financial relief for special and general damages, as well as interests and fees associated with the lawsuit, including attorneys’ fees.
