Cargo Handler Drops Freight on Man and Gets Sued

A man from Delaware County claimed that he was injured by one of the baggage handlers at Philadelphia International Airport. The filed complaint reported that the plaintiff said his leg was affected due to some freight being dropped on him. This resulted in him in filing a personal injury lawsuit. The freight handler was one of the plaintiff’s fellow employees.

The lawsuit was filed on June 14 by Boothwyn, Pa at the Philadelphia’s Court of Common Pleas for James Curley Jr. The plaintiff said that he suffered injuries in his left ankle due to William Bramble, who was an employee with Worldwide freight Services Inc, dropping baggage on him.

The incident took place on Feb 17, when Bramble was offloading some baggage in Cargo City, a building at the airport.

The lawsuit doesn’t give any details whether the plaintiff was an employee when the incident occurred or if he was just a passerby. The complaint does however state that since the incident took place in a restricted area; it further indicates that Curley must have been a fellow employee of Brambles.

Both World Wide Freight Services and Bramble are based in Philadelphia Airport’s Cargo City and are named in the lawsuit as defendants. The suit mentions negligence and negligent hiring in it.

Bramble was accused of failing to use the freight with proper care by Curley. Curley also accused Bramble of not using the forklift properly, and completely ignoring the safety and rights of the plaintiff by failing to watch out for the plaintiff. Curley further stated that the accused of sheer negligence on his part.

The lawsuit also mentions that Worldwide Flight Services is also partly responsible for the injuries caused to the plaintiff because the company had the responsibility to monitor the performance and work done by Bramble.

The lawsuit claims that the injuries to Curley caused him to have pain in his left ankle which bars him from performing daily tasks. It also states that Curley has suffered emotional distress and mental anguish due to these injuries.
Curley demands a jury trial and also to be compensated with $50,000.
